Abstract

This study aims to compare legal protections against the misuse of AI-based deepfake technology in Indonesia and China. This study uses a normative juridical method with a statutory and comparative approach, and examines primary, secondary, and non-legal legal materials to examine deepfake regulations in Indonesia and China. The results show that Indonesia still experiences a legal vacuum due to the lack of specific regulations governing AI-based visual data manipulation, resulting in law enforcement relying on generic articles that do not align with the nature of algorithmic manipulation. Meanwhile, China has adopted the Deep Synthesis Regulation (2023), which is preventative in nature through mandatory labelling, watermarking, identity verification, and liability for AI service providers, thus providing more comprehensive protection. Based on this comparison, this study concludes that Indonesia needs specific regulations regarding deepfakes to provide legal certainty, victim protection, and a more adaptive response to developments in artificial intelligence technology.
